| Description | Evidence of offender’s culpability is a complex issue, especially for law enforcing authorities. The reason for this comes from the nature of the culpability itself. In case of criminal liability of legal entities, only a culpability of qualified person can be accounted to legal entity. It is why the question of subjective matter of criminal act must be evaluated most thoroughly. Thus in my contribution I focus on confession of qualified person and practical aspects of section 8 (3) of the law No 418/2011 Coll. on Criminal Liability of Legal Persons and Proceedings against Them. I offer my own remarks and critical comments in order to provide partial recommendations that would lead to effective approach of the institutes concerned. |
