Description Regarding the deciding of guilt and punishment evidence is apparently the most important part of the criminal proceedings, which is also reflected by some of its basic principles, on which the criminal proceedings was originally based. The social development of past decades has nevertheless brought material sources of law of criminal procedure, that has led to such changes of the code of criminal procedure, which have caused a tension between the purpouses of the criminal procedure. This has been reflected also in the contemporary model of evidence, which is supposed to synthetise often very contradictory interests (protection of human rights ca. effective investigation of all crimes, immediate performation of evidence at court ca. securing the highest possible number of pieces of evidence etc.). This contribution aims to introduce some practical problems, that stem from this tension.
