Description This paper deals with the application of Art. 6(1) of the Convention for the Protection of Human Rights and Fundamental Freedoms (“ECHR“) in arbitration. The conclusion of an arbitration agreement is permissible under Art. 6(1), but the absence of constraint is a condition. It is undisputed that Art. 6(1) is applicable in court proceedings relating to arbitration and in compulsory arbitration. The direct application of Art. 6(1) in arbitration is still a question. The aim of this paper is to analyse the direct application of Art. 6(1) in arbitration, i.e. the obligation of arbitrators to apply this provision. First, the paper summarizes and evaluates the arguments against the application of Art. 6(1) in arbitration. Secondly, the obligations and responsibility of Contracting States are analysed. Finally, the paper deals with the obligation of arbitrators to apply Art. 6(1) from the point of view of the horizontal effect of human rights. The paper deals only with the view of the ECHR, European Court of Human Rights and national courts. The view of the arbitrators themselves stays aside.
