Description The paper is dedicated to the employee’s right to leave which is considered as one of the fundamental social rights of workers. The leave is one of the rest periods. Its purpose is to renew the employee’s workforce. Contrary to other rest periods, the employee taking the leave is secured by remuneration from his/her labour relation. The paper focuses on minimal standards stated by international instruments and EU law for national regulation of annual paid leave. Particular attention is paid to the interpretation of the right to annual paid leave in case-law of the Court of Justice of the EU and its impact on national law of Member States. Apart from the right to leave, the remuneration of employees taking the leave is analysed.
