| Description | The article deals with several current issues relating to lawsuits for declaration of state ownership of property, which historically belonged to churches and can be restored to them under the Act No. 428/2012 Coll. It tackles the problem whether action based upon § 18(1) of Act No 428/2012 Coll. can be used to demand declaration of state ownership if there was no breach of the restrictions on transfers of historical church property, the importance of impossibility of restitution of the property at hand and the question of distribution of burden of proof. |
