| Description | This paper focuses on an analysis of the key decisions of the Court of Justice of the European Union dealing with the relationship between the trade mark and the trade name. It is based, in particular, on the division of the mentioned rights on subject and object designations, their functions and the resulting limits for their use in practice. In the paper contains a definition of the term the trade name, the relationship and the limits of the use of the trade name and the trademark, and a comparison ofthis conclusions with the case law of the Czech courts. |
