Description This paper focuses on the road traffic legislation of the Czech Republic from the perspective of the road safety. It will demonstrate how the road safety is approached by the Czech legislator, the administrative authorities and by the Czech courts. Correct and effective legal regulation of sanctions for traffic offences, the possibility of individualization by the administrative authorities and judicial control, those are the factors that influence the preventive effect (general and individual) of the punishment can help to improve road safety. This paper will bring up selected recent legal questions of Czech road traffic law, such as consequences of material aspect of the offence; constitutionality of the owners/drivers liability and legal relevance of the case-law.
