| Description | The topic of this paper is Software Procurement by Contracting Authorities in the Form of a Competitive Procedure with Negotiation. Firstly, the conditions (reasons) for the use of this procedure are discussed. The discussions also addresses the authoritative interpretation of the provisions of Sec. 60 of Act no. 134/2016 Coll., on Public Procurement Procedure. Further attention is also be paid to vendor lock-in and to the partial steps in the procedure. This includes the possibility to request the tenderer’s list of intellectual property relevant to the public procurement held by the tenderer prior to the successful completion of the selection procedure and the list of the intellectual property that the contractor plans to establish in connection with the performance of the relevant contract. |
