| Description | The following article deals with the issue of determining the degree of culpability in relation to the consideration of the type and amount of the fine imposed in the case of two frequently dealt traffic offences. On the basis of the relevant legislation and case-law, the author critically assesses the conclusions used in decision-making practice regarding the presence of a rational and volitional component during conduct in the form of commission of the offences of speeding and driving without wearing a seatbelt. |
