In this commentary I explain the nature of the customs union, the link with GATT and WTO law, I provide the definition of 'goods', the free circulation of goods in the internal market, conditions of placing of imported goods on the market, release for free circulation, the concept of 'customs duties' and 'charges having equivalent effect', prohibited duties and charges. and levies that are permissible under EU law, the conditions for the adoption of a customs tariff, cooperation between Member States in customs matters, quotas and measures having equivalent effect, the personal scope of Article 34 TFEU, the material scope of that Article, the judicial exception (including relevant CJEU case law) and the relationship of Article 34 TFEU to other areas of EU law is addressed, as well as measures that are excluded from the scope of that provision, measures applied by Member States in exportation, and any exceptions under Article 36 TFEU. |
