Description The concept of a decision under the Code of Administrative Justice is closely related to an action against a decision of an administrative authority. The way in which we define this category determines not only the scope of this type of action but also of the other basic types of proceedings. In the practice of administrative justice, the boundary between a decision and a (non-lawful) interference appears to be the most problematic. This paper attempts to outline some “strategic” considerations in defining the relationship between these categories in the form of a triad of basic approaches to their relationship. These approaches are the extension of the interference, the extension of the decision, or the search for a “precise boundary” based on specified border criteria.
