Description The paper presents the newly established Supreme Administrative court of the Slovak Republic in comparison with its older counterpart in the czech Republic by assessing the preference for a private or a public role. The paper begins by assessing the first instance agenda that both courts deal with. Thematically, the courts deal with the same agenda, but the difference lies in the scope of the agenda. The Slovak court’s jurisdiction to review local elections is more demanding due to the fragmentation of electoral districts. Moreover, it also has more disciplinary proceedings. This contributes to a higher workload for judges with a non-review agenda. An analysis of the procedural regulation of cassation complaint (an remedy against a decision of a lower administrative court) shows that the workload of the Slovak (and also the czech, despite the existence of partial inadmissibility) court is subject to external influences, as the possibility of filing a cassation complaint is broad and the court has to decide on each of them on the merits, provided that the very basic formal requirements are met. Although its current caseload is manageable, this may not always be the case, as it is impossible for the court to control the number of cases that come before it and are decided.
