| Description | The chapter, following the broader legacy of Prof. Hoetzel's work, deals with the specific issue of forms of public administration. More specifically, it introduces and discusses at a basic level the so-called form borrowing to administrative activities. Rather than being a completely distinct legal institute, it is a legislative technique, the essence of which is the use of a statutory form different from its general purpose (the material content of the administrative activity to which the form in question is aimed). The form borrowing may be the result of a mistake, but usually it is a deliberate inconsistency between the form and the intended content. The consequence is usually an increase or decrease in the formalisation of the administrative activity in question, which is dealt with in more detail in the chapter. |
