| Description | The study focuses on the application of general principles of administrative procedure in decision-making processes concerning permission for a child to stay outside an institutional or protective educational facility. It analyses how the principles of legality, proportionality, predictability, and proper reasoning are reflected in the decision-making practice of child protection authorities and facility directors. Based on the amended Section 30 of the Act on Social and Legal Protection of Children, effective from 1 July 2025, the paper explores how the new procedural framework affects the protection of the child’s rights and the realization of the child’s best interests. |
