| Description | This article describes and analyzes a partial change to the labor law regulation within the so-called flexible amendment to the Labor Code, specifically concerning the statutory extension of the probationary period. Here, the amendment introduced an explicit rule stating that the probationary period is extended "by working days" and not "by the period of time," as was previously stated in the Labor Code. This step was intended to eliminate previous interpretational ambiguities and strengthen legal certainty, but the resulting wording of the provision in question generates numerous problems which ultimately tend to weaken the legal certainty of the parties involved. The article primarily addresses these fundamental interpretational problems and the ill-conceived consequences of the new regulation. |
