| Description | The paper deals with legal regulation of trade name and its absolute protection in according to the Commercial Code. Trade name can be protected by several laws, however the basis one is the defense offered by the Commercial Code (Act No 513/1991 Coll.). This protection is divided into two ways: the first one is the protection according to Section 12, Commercial Code, the other one is the protection according to Section 44 and subsq., Commercial Code (e.g. legal regulation of unfair competition). The first system offers the absolute protection of trade name (erga omnes), the second one offers the relative protection (among the competitors). |
