| Description | The paper deals with the judgment of the Supreme Court of the Czech Republic, which gave the claimant (one company) the rights to its trade name. This case consists of the absolute protection of the trade name under the Section 12 of Commercial Code; the claimant sued to change the trade name of the defendant. The principle element for the verdict was considerations whether the trade name of one company is able to confuse with the trade name of other company or not (see Section 10/1 of Commercial Code). |
