Description Presented paper focuses on the question of respect of human rights in international criminal proceedings. It explores the issue of transboundary abductions and seeks to answer the question whether criminal court should dismiss the case in the light of the fact the accused got to the court only through the violation of public international law and human rights. The state practice reveals to be ambivalent – the doctrine male captus bene detentus and the doctrine of abuse of process can be distinguished. The position of ICTY seems to prefer male captus bene detentus doctrine at least from Nikolic Appeal Chamber decision which formulated so called Eichmann exception. The article reveals problematic aspects of adoption ICTY approach by ICC and concludes it should prefer abuse of process doctrine.
