| Description | The article addresses the question of applicability of the limiting effect of the contractual penalty to the extent of damages in the case of intentional breach of contract. The author advocates that in such a situation the benefit of the limitation of damages should not be granted, with the only exception - that the possibility of intentional breach was covered by the contractual consensus in the agreement from the very beginning. |
