| Description | This text critical comments present situation and the move in the question of conception of basic principles of criminal procedure / criminal process law legis ferendae, on a backround of the real planes of a new Criminal Procedure Code of the Czech republic in the years 2007/2008 and 2009/2010. It points out the importance of basic principles from the way their formulation in the new Criminal Procedure Code point of view, first of all from the work of police, judiciary and prosecuting authorities point of view, during the interpretation and application of the new criminal process legislation. Conclusion: The basic principles are necessary to formulate in the Criminal Procedure Code explicitly, as one of prerequisities of the right interpretation and application. |
