| Description | The provider of electronic communication services has under the Belgian Criminal Procedure an obligation to disclose identification data of its users. Yahoo, Inc. refused to provide the data since the company is not a provider pursuant to the Belgian Act on Electronic Communications. Nevertheless, the penal law is according to the Supreme Court autonomous, i.e. definitions from another branch of law are not automatically applicable in the penal law. |
