Description Appointment of judges by president of the Czech Republic, on proposal of government, is just a legal act enclosing selection process, which has no strict legal framework. This situation creates significant space for arbitrariness, which could cause dysfunctions of the whole judicial power. Similar critic could be applied on the selection process of lay judges who together with professional judges participate in the exercise of judicial power. Contribution describes, analyses and compares status of judges and lay judges in the Czech Republic and Europe.
