| Description | The paper deals with selected theoretical as well as practical questions of diversion in the Czech criminal procedure, their system and characteristical traits as well as about problems, that occur together with the application of diversion in the real life. From the theoretical standpoint, the paper offers a summary of their basic definitional traits and approaches to their essence, inculding relevant foreign approaches. As the most pressing practical problems, the paper identifies divergent use of diversion, divided requirements on the plea of liability for the deed by the defendant and divided conditions for criminal records. |
