Description In the submitted article, the author thinks about some substantive law and procedureal consequences of section 12 par. 2 of the Criminal Code. Firstly, she reminds of historical context of this topic that has led to enaction of unifying opinion of the Supreme Court´s Criminal Division on aforesaid legal provision. In the light of this opinion´s conclusions she analyzes two functions of section 12 par. 2 of the Criminal Code as "interpretation rule" and "corrective" and she operates with them in the frame of criminal substantive law as well as criminal procedural law. In the last part of article, she mentions also inseparable connection of criminal law (judicial) with administrative law (penal), on basis of which an analyzed section 12 par. 2 of the Criminal Code stands.
