Description The article deals with the protection of religious feelings in the Czech Republic in the context of the unique case of Cardinal Duka’s dispute with the Brno theatre scene over plays with blasphemous elements. The author takes on a contextual analysis of the decisions issued in this dispute, in particular the Supreme Court’s judgment and the Constitutional Court’s ruling and points out the problematic aspects of the reasoning of both decisions. For the Supreme Court, the author focuses on its assertion that the right to the protection of religious feelings is part of the Charter of Fundamental Rights and Freedoms. Regarding the Constitutional Court’s ruling, the author considers its legality test, which extended the applicability of the civil action for the protection of personality to cases of reflexive harm to religious believers. The article takes into account the literature of Czech academics on the protection of religious feelings and the extensive case law of the European Court of Human Rights.
