| Description | This text analysis the question connectioned with parallel existence of the real criminal liability of juridical persons and of individual criminal liability of moral persons on this the same crime, which is commited by the moral perpetrator, who treats in the frame of the juridical person.It could be in the contradiction with the prohibition of double punishment (ne bis in idem). It was discovered on the basic of the approaches of the european, austrian and czech legislation and theory that the punishment on the juridical and moral person in this cases the prohibition of double punishment not breaks. |
