| Description | The paper is dealing with the concept of so called lex mercatoria and with the separate nonstate rules in the procedure before czech courts and arbitrators who proceed according the czech arbitration law. The development of lex mercatoria and the content of the particular conceptions within this doctrine are shortly described in the second chapter od this paper. The core of the paper is the analyse of the czech doctrine. It will be evaluated as the opinion on the existence of lex mercatoria as the question of the application of the particular rules of nonstate origin. In the final part of the paper the author presents her opinion on the position of non-state rules. |
