Description The very existence of a constitutional state (as the basic legal-political framework for the functioning of law, the state, and a democratic political system) – i.e., of that without which today (at least in the entire Euro-Atlantic region) it is impossible to imagine the democratic organization of society in any way – is, inter alia, absolutely dependent upon the proper performance of judicial power within the state. One of the essential conditions for the truly proper performance of judicial power, and thus a contribution toward the fulfilment of the content requirements of a constitutional state, is actually the manner of the very creation of judicial power, i.e., the manner of selection of judges as persons who implement judicial power.
