| Description | In this contribution, the author focuses on the "foreign thing" feature contained in the body of criminal offense of embezzlement. First, he points to selected types of civil obligations, on the basis of which the offender is voluntarily entrusted with the foreign thing, including examples from the decision-making practice of the Supreme Court, which can become civil ground for criminal offense of embezzlement. Special attention he pays to deposit. Subsequently, he defines the difficulties that arise during the legal qualification in connection with deposit, specially specifics related to deposit of things determined by type. |
