| Popis | Is the imposing of criminal sanctions for defamation still desirable and tenable in todays society, especially in view of the possible negative consequences for the work of the media and specific journalists in reporting on matters of public interest? The paper answers this question by analysing the long-evolving case law of the European Court of Human Rights, international comparisons across states, and a review of the imposition of criminal and other types of sanctions in the national context. It also takes into account the long-standing recommendations of international organisations calling for the total abolition of the crime of defamation from the legal systems. |
