| Popis | This chapter deals with the current trends of sanctioning in the Czech Republic. It focuses on the position of the punishment of imprisonment in the sanction system of criminal law in the new criminal code No. 40/2009 Sb., in effect from 1 January 2010, approaching the issue from the point of view of the fundamental principles of substantive criminal law and the 2011 and 2012 amendments to the criminal code. After identifying some of the problems related to alternative punishments, the paper adopts a critical view towards the trend of replacing one ineffective alternative punishment with another. |
