| Popis | Access to the court has evolved, according to Cappelletti, through several stages corresponding with the development of the human rights theory. The present paper shows that freedom of religion in Czechia has undergone similar development within the last 30 years. First, the freedom of religion posed only negative obligations for the state that had to refrain from creating obstacles. However, later positive obligations appeared in the case law as well. Only recently, there might be a new line of understanding the freedom of religion as a source of obligations to systematically revise the states’ approach. |
