| Popis | From a civil law perspective, the cross-border use of the Metaverse and avatars presents significant challenges that necessitate the development of a universal legal framework to effectively regulate these phenomena at the international level. Civil law principles emphasize the protection of individual rights, contractual relations, property rights, and personal data, all of which are increasingly affected by activities within the Metaverse. The transnational nature of these digital environments complicates the determination of applicable law, jurisdiction, and enforcement of civil claims, raising issues of legal certainty and rights protection for users across different jurisdictions. Without a comprehensive international legal framework, disputes related to digital property, avatar ownership, contractual obligations, privacy breaches, and liability may remain unresolved or be arbitrarily enforced, undermining trust and stability in digital civil relations. Therefore, establishing a unified legal approach is essential to ensure consistent protection of civil rights, regulate civil transactions, and facilitate fair resolution of disputes in the evolving digital space of the Metaverse. |
