Climate Protection in the Environmental Impact Assessment of Intensive Livestock Farming Projects

| Popis | Intensive livestock farming constitutes a substantial source of greenhouse gas emissions and, concurrently, a sector potentially vulnerable to the adverse effects of climate change. Under both European Union law and national legislation, climate protection is mandated as an integral component of environmental impact assessment (EIA) procedures for proposed projects. This contribution draws on doctoral research focused on the legal regulation of climate-related aspects in intensive livestock farming and critically examines the extent to which climate protection requirements are substantively reflected in administrative decision-making practice. Through an analysis of selected projects, the paper evaluates whether climate-related impacts are assessed with sufficient depth and whether they are effectively incorporated into binding EIA conditions, or whether such considerations are addressed merely in a formalistic manner. This inquiry reveals potential discrepancies between the normative expectations established by legal frameworks and their actual implementation in administrative practice. The conclusion reflects on the capacity of the EIA mechanism to function as a meaningful regulatory tool for climate protection in the context of intensive livestock farming, or whether it remains, in this respect, a predominantly procedural instrument lacking tangible regulatory effect. |
