| Popis | This paper examines whether the use of AI-based decision-support systems in judicial proceedings violates the right to a fair trial. It analyzes concerns raised by the Council of Bars and Law Societies of Europe (CCBE) and legal scholarship regarding undue influence, judicial independence, and impartiality. Using the COMPAS system and the State v. Loomis case as key examples, the paper assesses how algorithmic recommendations may distort judicial reasoning. It concludes that AI support systems, if critically evaluated and transparently justified by judges, need not breach fair trial guarantees. However, improper reliance on such systems may compromise legal safeguards, necessitating stricter conditions for their admissible use in courtrooms. |
